Many years ago, I had a frank conversation with an American diplomat about the phenomenon of racism in his country. He told me:
\n“Yes, racism exists in America, but we also have an independent judiciary. Racism is prohibited by law, and anyone who becomes its victim can turn to the courts.”<\/p>\n
I asked him directly: If that is the case, then why do some African Americans distrust the judiciary, resort instead to protests and demonstrations, attack politicians online, and establish numerous human-rights organizations to defend their rights?<\/p>\n
The diplomat replied: “I will tell you something that is usually left unspoken in our country.”
\nI asked him: “What is it ?”<\/p>\n
-Is it conceivable that when a crime is committed, and the perpetrator happen to be African American, the sentence is reduced because his ancestors were enslaved and victims of racism ? He answered firmly.<\/p>\n
“No. Anyone who commits a crime is subject to the same punishment as any other American, regardless of color or religion.”I answer him<\/p>\n
He then continued: “Our problem today is that part of the new generation demands utopian expectations that simply cannot stand. We all detest racism and we all fight it on human principles and according to the law, but turning past oppression into a weapon brandished against the judiciary-demanding differentiated sentencing between Whites and Blacks-is “unacceptable.<\/p>\n
Modern American history is a long struggle to uproot racism in a society that is ethnically and religiously diverse. If racism appears within an institution or among individuals, the issue must be addressed legally, without political posturing or placing the burden of past crimes on today\u2019s white Americans. Everyone in this country must understand that they are bound to coexist under their Constitution, and they have no other option.<\/p>\n
However, this viewpoint-despite its legal coherence-overlooks a significant aspect of reality. Problems linked to discrimination still manifest in the unequal sentencing of White and Black defendants in comparable cases, as well as in the preconceived biases held by some police officers toward Black citizens. These are documented facts embedded in America\u2019s collective memory. Such practices continue to fuel anger and mistrust among many African Americans, and lead some activists to interpret their relationship with the justice system through the lens of the psychological and social residues inherited from the era of slavery and blatant discrimination. This does not necessarily mean they are formally demanding lighter sentences ; rather, it reflects a deep sense of historical grievance and its contemporary echoes.<\/p>\n
Therefore, a serious and comprehensive dialogue is urgently needed within American society-one that addresses the legal, historical, social, and policing dimensions of the issue. Only through such a holistic approach can a fair consensus be reached, one that does justice to all sides and removes the matter from the realm of short-term political calculations. Otherwise, the wound of racism will remain open, no matter how strict the legal texts may be.<\/p>\n
