What “truce” are they speaking about ?

By Afaf Aniba

These are the provisions of the 9 October truce between Hamas and the Zionist enemy. We will evaluate each clause about two months after the agreement was reached between the two sides.

Below are the main points of the agreement between Hamas and Israel, according to what was reported by global media outlets:

Prisoners

Upon Israel’s gradual withdrawal from the vicinity of Gaza, Hamas would provide information about the Israeli captives. The withdrawal did not take place as agreed; no full withdrawal occurred from all of Gaza’s surroundings.

Within 72 hours of signing, Hamas was to hand over all living Israeli captives held by the factions in the Gaza Strip, numbering 20. All living captives were handed over to the Zionist side.

Within 72 hours, Hamas was to hand over the remains of about 28 Israeli captives in Gaza, in return for Israel providing all information it has on Palestinian prisoners. Most of the bodies were delivered, with only a small number not recovered due to massive structural destruction, difficulty locating bodies under the rubble, and Israel’s refusal to allow in heavy debris-removal cranes.

An information-exchange mechanism is formed between Hamas and Israel through mediators and the International Committee of the Red Cross.

Hamas sends a list of the information it has on the Israeli captives, both living and deceased. Hamas adhered to sending the list.

The handover of captives is carried out without any ceremonial or media appearance. This was done with no celebratory or media displays.

The living captives are handed over on Sunday, 12 October, until 6 a.m. the following day, along with the delivery of whatever remains can be recovered.

An Egyptian delegation is sent to the Ofer crossing, where captives are gathered to verify the names scheduled for release, in coordination with the mediators.

An Egyptian delegation, along with the Red Cross, visits Ofer and Ketziot prisons to verify the names of Palestinian prisoners.

Hamas in Gaza coordinates with the Red Cross regarding the Israeli captives, and once procedures are completed by both sides, the vehicles carrying captives from each side proceed.

Hamas releases 20 Israeli captives in a single batch, in exchange for Israel releasing about 2,000 Palestinian prisoners — among them 250 serving life sentences and 1,700 arrested since the start of the 2023 war on Gaza. The freed Palestinian prisoners were in a state of psychological shock, most had been subjected to torture, and many of the returned bodies were mutilated and unidentifiable. Some Palestinian captives’ remains have still not been returned.

Humanitarian Aid

The war is to stop within 72 hours after Israel and Hamas approve the agreement’s terms. The war did not stop within 72 hours and is still ongoing.

Humanitarian aid is to enter immediately, and the ceasefire agreement of 19 January 2025 is to be implemented. Only a very small amount of aid entered, and what entered was insufficient to sustain life for the besieged population .The Office for the Coordination of Humanitarian Affairs (OCHA) and the Red Cross have repeatedly confirmed the obstruction of aid delivery, the continuation of military operations, and the lack of permission for displaced people to return.

A minimum of 600 trucks per day is to enter Gaza upon signing the agreement, including aid, goods for the private sector, and 50 fuel and gas trucks, totaling no fewer than 4,200 trucks per week. This volume never entered Gaza.

UN agencies and other organizations receive and distribute the humanitarian aid.

Aid is allowed through five crossings: Kerem Shalom in the south, Kisufim in the center, Karni, Mefalsim, and Erez east of Gaza City. Most crossings remain closed, especially Rafah Crossing.

A follow-up operations room is formed, consisting of Egypt, Qatar, Turkey, the United States, Israel, and Hamas. The Arab parties and Hamas recorded serious violations of the truce, while Israel and the United States disregarded commitments altogether.

Withdrawal

The gradual withdrawal of the Israeli army from the vicinity of Gaza begins upon approval of the agreement. No full withdrawal occurred from Gaza’s surroundings.

The withdrawal toward the agreed-upon demarcation line is to take less than 24 hours after Israel’s approval.

The Israeli army is to withdraw from Gaza City, the north, Rafah, and Khan Younis according to the provisions. None of these withdrawals were carried out.

The return of displaced people from southern Gaza to Gaza City and the north begins as soon as implementation starts. No return occurred due to total destruction, the division of Gaza, the presence of mines everywhere, and the lack of incoming aid. In short: what “truce” are they speaking about?
